Criminal Trespass Program
IRVING POLICE DEPARTMENT CRIMINAL TRESPASS PROGRAM
The Criminal Trespass Program allows property owners or those responsible for the property and the Irving Police Department to work together to reduce criminal activity on private property. The Criminal Trespass Affidavit form that you sign is allowing the Irving Police Department to act as your agent in your absence. As an example; when there is no management/owner or any other staff on site that could make a decision on your behalf. This is primarily used by officers out in the field while the business is closed and you have an individual(s) trespassing on your property. An individual arrested for trespassing will be charged with a violation of the Texas Penal Code Sec. 30.05, Criminal Trespass. The property owner/manager will be the person formally filing the criminal complaint against the violator(s). Program participants are required to renew their desire to participate in the program each year.
To begin the process, the property owner or the property owner’s agent, must complete the following:

The property owners or those responsible for the property will be required to post IPD issued “No Trespassing” signs in prominent locations around your property. The location of the signs will be designated by an Irving Police Department Crime Prevention Officer.
After admittance into the program, you will be required to renew your Criminal Trespass Affidavit form for each upcoming year. Each year will be dated January 1st through December 31st of the next year. Towards the end of the year, you will be sent a renewal notice to determine if you wish to continue participating in this program. When names of authorized person(s) change within the year, you will be required to immediately provide the Irving Police Department with a new Criminal Trespass form updating your new authorized representative or employee of the property who has lawful control of premises by ownership, tenancy, official position or other legal relationship. This individual, designated by the controlling agent or owner of a premise, has the authority to process individuals seeking appeal of trespass notices. Failure to update your designated authorized person, return an updated or renewal Criminal Trespass Affidavit form, or non-compliance to program guidelines may result in removal from the program. All signage remains the property of the City of Irving and their removal and return will take place upon voluntary exit of the program or removal from the program by the Irving Police Department.
By participating in this program, Irving Police Officers will check your property during the normal course of patrolling or while answering a call for police service at the location. Please understand that this does not mean that an officer will be available to check your property on a regular basis. Rather, officers will check the property as time and resources allow.
The owner/agent will maintain and update a Criminal Trespass file and or any other necessary paperwork. If you determine that a Criminal Trespass Warning was given in error, you must contact the Irving Police Department’s Community Services Division immediately.
The Irving Police Department is not responsible for civil litigation that results out of this agreement based on incorrect or incomplete information provided by you or as a result of an arrest. The Irving Police Department will not make any decisions regarding the use or disposition of your property.
